About Kristen

Kristen King Jaiven, Esq. is an attorney that focuses her practice on the representation of small businesses, including real estate brokerages and other related business ventures. Kristen has experience in DBPR investigations, Board of Realtor complaints, and brokerage compliance matters. She also assists with corporate operations and implementing robust marketing plans for various types of business ventures. Kristen currently represents the 4th Appellate District on the Florida Realtor-Attorney Joint Committee and serves as Co-Chair of the Real Property, Probate, and Trust Law Section’s (RPPTL) Residential Real Estate and Industry Liaison Committee.


Previously, Kristen served as the General Counsel and Vice President of The Signature Real Estate Companies - one of the largest privately-owned real estate brokerages in the state of Florida - and as in-house counsel for American Tower Corporation focusing on commercial real estate. During law school, Kristen clerked for the South Florida Water Management District focusing on environmental enforcement matters. She is the author of A Proposed Reconciliation of Stakeholder Interests in the GE Soybean Industry and Role of Earth Jurisprudence Principles (Florida A&M University Law Review 2014), co-author of The Value of South Florida Real Estate when A1A is Under Water: Sea Level Rise and Private Property Rights (Real Property, Probate & Trust Law Section of the Florida Bar’s Spring ActionLine Issue), and co-author of a chapter on factory farming in What Can Animal law Learn from Environmental law? (Randall S. Abate, ed., ELI Press, 2015 and second edition 2020). Kristen holds a J.D. from St. Thomas University School of Law with a Certificate in Environmental Justice and has an LL.M. in Environmental Law from Vermont Law School with a Certificate in Food and Agriculture Law.

 

CE Programs:

The Listing Agreement

This class will cover the components of the a listing agreement and will cover the different types of listing relationships between seller and Broker. We will go through different listing and commission agreements and instruct students on the proper completion of these agreements. This class will cover practical scenarios related to listing agreements and listing relationships. 3 hours CE credit.

Vacant Land Contracts: Handling the Real Estate Transaction

This course will discuss the nuances of buying or selling vacant land. We will touch on the differences between vacant land and other real property and discuss how to properly prepare a vacant land contract. The class will go into due diligence, construction and other issues related to vacant land property. Whether you are interested in learning about new residential construction or multifamily/commercial construction, this class will teach you all you need to know about vacant land properties. 3 hours CE credit.

NON CE programs:

Buyer Broker Mastermind: This course will provide an overview of the lawsuits filed by home sellers and buyers against the National Association of Realtors and real estate brokerages throughout the country and the practice changes arising from NAR's settlement in the Sitzer/Burnett Case. The course will include a discussion of new forms contracts, and best practices.

Florida Real Estate Licensee Marketing and Advertising Rules: A guide to advertising laws, including general advertising laws and state rules applicable to advertising by real estate agents. This class explains how to avoid false advertising and misrepresentation claims and covers advertising rules under the MLS and NAR Code of Ethics. 

Avoiding Issues with FREC: A guide to avoiding the most common violations of real estate laws committed by real estate agents and steering clear of issues with the Florida Real Estate Commission (FREC). The course will begin with an overview of the Florida Real Estate Commission and their role in regulating the real estate industry. Participants will learn common licensing violations, including advertising complaints, failure to disclosure issues, and mishandling of funds.
